The 18 year-old Fallon man arrested Thursday evening for shooting another Fallon man last week is facing additional charges.
Ebelio Erasmo Tapia Jr. of Stillwater Avenue is charged with assault with a deadly weapon, battery with a deadly weapon causing substantial bodily harm to the victim, principal to challenges to fight, conspiracy to commit a crime or unlawful act and resisting/delaying/obstructing a public officer.
According to the criminal complaint, Tapia shot and wounded Patrick Black in the arm near Churchill and Douglas Streets on June 16 as two other men prepared to fight.
Tapia is accused of aiding and encouraging Jose Garcia to fight Jonathon Brown by going to the location with Garcia to act as an armed backup.
The preliminary investigation shows that two groups of young adults got together at about 10 p.m. on Tuesday in an alley near Churchill and Douglas streets for a confrontation.
Fallon Police Chief Kevin Gehman said Tapia allegedly pulled a handgun and fired a few shots, one of which struck Black.
“I think they were planning some sort of altercation, and someone produced a handgun,” Gehman said last week, adding some people investigators contacted, claim to not have been at the location.
Tapia is charged with assault with a deadly weapon for allegedly pointing a revolver at a group of people that night. On the conspiracy charge, he is accused of conspiring with three men to gather near Churchill and Douglas streets for the fight.
Tapia is also charged with a misdemeanor for willfully and unlawfully resisting, obstructing and delaying a Fallon police officer who investigated the shooting.
If convicted, Tapia faces two to 15 years in prison for battery with a deadly weapon, one to six years for assault with a deadly weapon and another one to six years in prison for principal to challenges to fight. The conspiracy charge carries a punishment of one year in jail and resisting/delaying/obstructing a public officer carries a penalty of six months in the county jail.
Black was transported to Renown Medical Center in Reno last week with non-serious or life-threatening injuries.
Tapia is currently being held in the Churchill County Jail on a $53,500 bail — $30,000 for battery with a deadly weapon, $20,000 for assault with a deadly weapon and $3,500 for conspiracy. He had his initial appearance in Justice Court on Tuesday afternoon.
